Can a Nevada Court Order Private School Tuition in Divorce?

When divorcing parents in Las Vegas cannot agree on private school for their children, Nevada courts decide whether private school tuition qualifies as an upward deviation from guideline child support. NRS 125B.080 authorizes courts to order deviation when the child has extraordinary educational needs. Bishop Gorman, The Meadows, Faith Lutheran, and Davidson Academy are common subjects of Clark County custody disputes — with annual tuition ranging from $8,000 to $30,000.

How NRS 125B.080 Governs Educational Expense Deviations

Nevada child support guidelines under NRS 125B.070 calculate support as a percentage of gross monthly income: 18% for one child, 25% for two, 29% for three, 31% for four. These percentages assume ordinary expenses including public school. Private school tuition is an extraordinary educational expense requiring a separate court order under NRS 125B.080(9)(b). Courts weigh the child’s established attendance history at the private school, both parents’ ability to contribute, the child’s educational needs or special circumstances, and whether a transfer to public school would cause hardship. A child who has attended the same private school for years has a stronger case for continued enrollment than one newly enrolled.

Legal Custody and School Selection Disputes

School selection is a legal custody decision. Under NRS 125.490, Nevada courts presume joint legal custody is in the best interest of the child. When both parents share joint legal custody, neither parent can unilaterally enroll or withdraw a child from private school without the other parent’s agreement or a court order. Enrollment application deadlines, tuition deposits, and waitlist decisions frequently create emergency motion practice in Clark County Family Court when co-parents cannot reach agreement. Courts may appoint a parenting coordinator to break the deadlock without a full evidentiary hearing.

How Private School Costs Are Allocated Between Parents

When the court orders private school tuition as a child support deviation, it allocates cost between parents — most commonly pro-rata based on each parent’s share of combined income, or 50-50 when incomes are roughly equal. The order should specify the school by name, the annual tuition maximum, how cost increases are handled, transportation and uniform costs, and whether both parents must consent before switching schools. Without these specifics, the order generates contempt litigation every school year. Private school orders are modifiable on substantial change in circumstances under NRS 125B.145 — including job loss, significant income reduction, or closure of the school.
