What Constitutes a Substantial Change in Circumstances in Nevada

Nevada courts require that the change in circumstances be substantial, material, and not contemplated at the time the original order was entered. Examples that Nevada courts have found to constitute substantial changes include: a parent’s move that significantly disrupts the child’s school and social life, a parent’s new work schedule that makes the current custody arrangement unworkable, documented substance abuse or domestic violence that was not present at the original order, a child’s reaching an age where they can express meaningful preferences, and significant changes in either parent’s mental or physical health. Changes that were anticipated at the time of the original order — such as a child starting school or advancing to middle school — generally do not qualify as substantial changes warranting modification.
