If you or your children are in danger, getting a protective order in Henderson Nevada may be possible the same day. As a Henderson Nevada domestic violence attorney, Michelle Hauser at Hauser Family Law understands the urgency of domestic violence situations and is committed to helping victims access legal protection as quickly as the law allows. This article explains the three types of protective orders available in Nevada and how to obtain immediate protection.
Three Types of Nevada Protective Orders
Emergency Protective Order (EPO) — Available the Same Day from Law Enforcement
An Emergency Protective Order is issued by law enforcement — typically at the scene of a domestic violence incident. Any Nevada law enforcement officer can issue an EPO when they have probable cause to believe domestic violence has occurred or is imminent. An EPO can be issued 24 hours a day, 7 days a week, including nights, weekends, and holidays. It takes effect immediately and can order the abuser to leave the family home, have no contact with the victim, and stay away from children.
An EPO is temporary — it lasts up to three business days — but it provides critical immediate protection while you seek a Temporary Protective Order from the court.
Temporary Protective Order (TPO) — Available the Same Day from the Court
A Temporary Protective Order is issued by the Clark County Family Court on the basis of a written request — no hearing is required, and the abuser is not notified before the order is issued. Henderson victims can apply for a TPO directly at the courthouse, and judges are available to sign TPOs on the same business day in most cases. A TPO can order the abuser to stop the violence, leave the family home, have no contact with the victim and children, and stay away from the victim’s workplace and school.
A TPO is effective for 30 days and can be extended while a hearing for an Extended Order is scheduled.
Extended Protective Order — Up to Two Years
After the TPO is issued, the court will schedule a hearing where both parties can appear. At this hearing, the court decides whether to issue an Extended Protective Order, which can last up to two years and may be renewed. At this hearing, having an experienced domestic violence attorney present is critical — the abuser may also appear with their own legal representation, and the quality of the evidence and legal argument presented matters significantly to the outcome.
