Nevada Divorce and 401k Retirement Accounts — What Las Vegas Clients Need to Know

ARE RETIREMENT ACCOUNTS COMMUNITY PROPERTY IN NEVADA?

In Nevada, contributions made to a 401k or other retirement account during the marriage are community property — regardless of whose name the account is in. The portion accumulated before the marriage and after separation is generally separate property. Determining the community and separate portions requires careful analysis of account history and contribution records.

HOW A 401K IS DIVIDED IN NEVADA DIVORCE

401k accounts and other qualified retirement plans cannot simply be split by agreement in the divorce decree. Dividing a 401k requires a separate court order called a Qualified Domestic Relations Order — commonly known as a QDRO. The QDRO instructs the plan administrator to divide the account and transfer the non-participant spouse’s share into a separate account without triggering early withdrawal penalties or immediate tax liability.

Failing to obtain a QDRO after the divorce is final — the plan administrator will not honor a divorce decree alone. Accepting a retirement account offset without understanding its present value versus other assets like real estate. Not accounting for the tax treatment differences between pre-tax 401k funds and Roth accounts.
