Nevada Child Custody Jurisdiction Attorney Las Vegas
When parents live in different states — or when one parent relocates out of Nevada with children after a custody order is entered — questions of which state has jurisdiction to hear custody disputes become critical and legally complex. The Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA), adopted in Nevada as NRS Chapter 125A, governs these interstate custody questions. The UCCJEA determines which state’s courts have authority to make initial custody determinations and to modify existing orders, and it provides mechanisms for enforcing Nevada custody orders in other states and enforcing other states’ orders in Nevada. Hauser Family Law’s Las Vegas family law attorneys handle multi-state custody disputes and jurisdictional challenges efficiently.
Establishing Home State Jurisdiction Under the UCCJEA
Under the UCCJEA, Nevada is the child’s home state — and thus has jurisdiction to make an initial custody determination — if the child lived in Nevada with a parent for at least six consecutive months immediately before the proceeding is filed, or if Nevada was the child’s home state within six months of filing and a parent still lives in Nevada. If Nevada is not the home state, jurisdiction may exist under significant connection jurisdiction if the child and at least one parent have significant connections with Nevada and substantial evidence regarding the child’s care is available here. Hauser Family Law analyzes jurisdictional facts quickly and advises clients on where to file to secure the most favorable jurisdictional position.
Modifying Out-of-State Custody Orders in Nevada
To modify another state’s custody order in Nevada, Nevada must have jurisdiction under the UCCJEA and the original state must either no longer have jurisdiction or must decline to exercise it. Nevada courts will not modify another state’s order while that state retains jurisdiction. When the child and all parties have left the original state and established new connections elsewhere, jurisdiction may shift to Nevada. Hauser Family Law handles the procedural steps required to register and then modify out-of-state custody orders in Nevada’s family court system.
