Nevada Child Name Change After Divorce Attorney Las Vegas

Nevada law allows a child’s name to be changed through the court, but the process requires either both parents’ consent or a court finding that the name change serves the child’s best interests. Nevada Legal Standard for Child Name Change

Under NRS 41.280(3), a petition to change a minor child’s name requires consent from both parents with legal custody, or a court order after a hearing if one parent objects. When one parent objects to a child’s name change, the court applies the best interests of the child standard — not a presumption in favor of either parent’s preference. Nevada courts consider whether the name change would benefit the child, whether the child has a meaningful relationship with the parent whose name would be removed, the child’s own preference (given more weight as the child ages), whether the name change would cause confusion or embarrassment, and whether the request is motivated by an attempt to alienate the child from the non-requesting parent.

Process for Child Name Change in Clark County

A name change petition for a minor is filed at the Clark County District Court. Required documents include a petition signed under penalty of perjury, the child’s current birth certificate, proof of the petitioning parent’s identity, and either the other parent’s written consent or proof of service if the other parent will be given notice and an opportunity to object. If the other parent cannot be located after diligent search, service by publication may be available. After the court approves the name change, a certified copy of the order is submitted to the Clark County Health Department to update the birth certificate.
