When Can You Modify Child Support in Nevada and How Do You File?

What Counts as a Substantial Change in Nevada?

Nevada law requires a “substantial and material change in circumstances” before a court will consider modifying a child support order. The most common qualifying changes include a significant change in either parent’s income (Nevada guidelines use a threshold of approximately 20% or more), loss of employment or a new job with substantially different pay, changes in the child’s needs (such as significant medical expenses), and changes in custody or parenting time arrangements.

How to File a Modification Motion in Clark County

To modify child support in Clark County, you file a Motion to Modify Child Support Order with the Clark County Family Court. The motion must explain the substantial change in circumstances and include current financial information — income verification, tax returns, pay stubs, and documentation of any changes in the child’s needs. The other parent is served with the motion and has an opportunity to respond.

If both parents agree to the modification, the process is significantly simpler — a Stipulation and Order can be prepared and submitted for the judge’s signature. If the modification is contested, a hearing will be scheduled.

What the Court Considers in a Modification

Nevada uses a formula-based approach to child support (NRS Chapter 125B) that is primarily based on each parent’s gross monthly income and the number of children.
